GOCABY App Policy Terms and Conditions

These Terms and Conditions ("Policy") govern the use of the GO App ("App") provided by GOCABY Technologies Ltd. ("GO APP"). By downloading, accessing, or using the App, you agree to be bound by this Policy. Please read these terms carefully before using the GO App.

  • 1. Acceptance of Terms

    By using the GO App, you agree to comply with these Terms and Conditions and all applicable laws and regulations. If you do not agree to these terms, you may not use the GO App.

    • 2. Use of the GO App
      • 2.1. Eligibility: You must be at least 18 years old and capable of entering into a binding contract to use the GO App.
      • 2.2. License: GOCABY grants you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal use.
      • 2.3. Prohibited Activities: You agree not to engage in any activity that:
        • a) Violates any laws, regulations, or third-party rights.
        • b) Interferes with the proper functioning of the GO App or disrupts the experience of other users.
        • c) Attempts to bypass or manipulate GOCABY's systems or technology.
        • d) Involves unauthorized access to or use of GOCABY's proprietary information.
        • e) Infringes upon GOCABY's intellectual property rights or those of third parties.
        • f) Harasses, threatens, or harms GOCABY drivers, other users, or any individual or entity.
        • g) Involves fraudulent or deceptive practices, including false or misleading information.
    • 3. GOCABY Services
      • 3.1. Ride Requests: The GO App allows you to request transportation services from independent drivers. GOCABY does not provide transportation services directly but acts as an intermediary between you and the drivers.
      • 3.2. Driver Acceptance: GOCABY matches your ride request with available drivers, but driver acceptance is not guaranteed.
      • 3.3. Fare Calculation: GOCABY uses a dynamic pricing model to calculate fares based on factors such as distance, time, and demand. Fares may vary and are displayed in the app prior to and end of booking .
    • 4. Payments

      You agree to pay for the rides you request through the payment method linked to your GOCABY account. GOCABY may charge additional fees for certain services or circumstances.

      • 4.1. Payment Processing: To ensure secure and convenient payment processing, GOCABY partners with trusted third-party service providers. Here's how payments are processed.
      • 4.2. Card Payments: All card payments are processed by Paystack Ltd, a secure third-party payment gateway. GOCABY does not store or have access to Users' card details. Users' payment information is securely transmitted to Paystack Ltd for payment processing.
      • 4.3. Wallet and Banking Transactions: All Wallet and Banking transactions are processed through Providus Bank, a trusted banking partner. Users' transactional information is securely transmitted to Providus Bank for processing.
      • 4.4. Liability Exemption: Please note that GOCABY assumes no liability for any issues, errors, failures, or disputes that may arise during the payment process. This includes, but is not limited to, payment failures, errors in processing, unauthorized transactions, or any other related matters.

        GOCABY is solely acting as an intermediary between the Users and the respective payment service providers. While we strive to ensure a seamless payment experience, we cannot guarantee the performance, security, or availability of the payment service providers. Users are responsible for ensuring the accuracy of their payment information and resolving any payment-related issues directly with the respective payment service providers. Any disputes, liabilities, or claims arising from payment failures, errors, or unauthorized transactions are solely between the User and the payment service provider.

        By using GOCABY and making payments through the App, you agree to release GOCABY from any liability related to payment processing and acknowledge that any recourse or resolution shall be sought directly with the payment service providers involved.
    • 5. User Responsibilities
      • 5.1. Account Information: You are responsible for maintaining accurate and confidential account information.
      • 5.2. Compliance with Laws: You must comply with all applicable laws, regulations, and licensing requirements when using the GO App.
      • 5.3. Safety: You are responsible for your own safety during rides. GOCABY encourages you to review driver and vehicle details, share trip information with trusted contacts, and use your judgment to ensure a safe experience.
    • 6. Promotions & Bonuses
      • 6.1. Driver bonuses are paid out weekly, also any trip that is a base fare trip does will not be included in the bonuses.
      • 6.2. Any attempt to defraud the system either by driving a users 3 time at a stresh will lead to bonus/performance reductions.
    • 7. Amendments to GOCABY Policy

      GOCABY may modify or update this Policy at any time by providing notice through the GO App or other means of communication. It is your responsibility to review the updated terms and conditions. Your continued use of the GO App after the modifications constitutes your acceptance of the revised Policy.

      • 8. Termination

        GOCABY reserves the right to suspend or terminate your access to the GO App, at its discretion, for any reason, including but not limited to violations of this Policy or engaging in prohibited activities. Upon termination, you must immediately cease using the GO App.

        • 9. Limitation of Liability
          • 9.1. To the fullest extent permitted by law, GOCABY shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or in connection with your use of the GO App.
          • 9.2. GOCABY does not guarantee the availability, quality, safety, or legality of rides provided by drivers. You acknowledge that you assume all risks associated with using the GO App and engaging in rides arranged through the app.
          • 9.3. In jurisdictions where the exclusion or limitation of liability is not allowed, GOCABY's liability shall be limited to the maximum extent permitted by law.
        • 10. Indemnification

          You agree to indemnify and hold GOCABY, its affiliates, and their respective officers, directors, employees, and agents harmless from and against any claims, liabilities, damages, losses, and expenses, including reasonable Legal fees, arising out of or in connection with your use of the GO App, violation of this Policy, or infringement of any rights of third parties.

          • 11. User Conduct
            • 11.1. Compliance with Laws: You agree to comply with all applicable laws and regulations while using the GO App.
            • 11.2. Prohibited Conduct: You shall not engage in any conduct that is unlawful, harmful, defamatory, abusive, harassing, or infringes upon the rights of others.
            • 11.3. Code of Conduct: You are expected to treat drivers and other users with respect and courtesy. Any form of discriminatory, offensive, or inappropriate behavior will not be tolerated.
          • 12. Feedback and Ratings
            • 12.1. Feedback: GOCABY encourages you to provide feedback on your experience using the GO App. Any feedback, suggestions, or ideas you provide may be used by GOCABY to improve its services without any obligation to compensate you.
            • 12.2. Ratings and Reviews: You may provide ratings and reviews for drivers. Your ratings and reviews must be accurate, fair, and based on your actual experience.
          • 13. Intellectual Property Rights
            • 13.1. Ownership: The GO App and all associated intellectual property rights are owned by GOCABY. You may not use, copy, reproduce, distribute, or modify any part of the GO App without prior written consent from GOCABY.
            • 13.2. Trademarks: GOCABY's trademarks, logos, and service marks used in connection with the GO App are the property of GOCABY. You may not use these trademarks without GOCABY's prior written permission.
          • 14. Third-Party Services and Content

            The GO App may contain links to third-party services, websites, or content that are not owned or controlled by GOCABY. GOCABY does not endorse or assume any responsibility for the content, privacy policies, or practices of third parties. You access and use third-party services at your own risk.

            • 15. Amendments and Modifications

              GOCABY reserves the right to modify or update these Terms and Conditions at any time without prior notice. Any changes will be effective upon posting the updated Terms and Conditions within the GO App. It is your responsibility to review the Terms and Conditions periodically.

              • 16. Severability

                If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue to be valid and enforceable to the fullest extent permitted by law.

                • 17. Waiver

                  The failure of GOCABY to enforce any provision of these Terms and Conditions shall not be deemed a waiver of such provision or the right to enforce it.

                  • 18. Assignment

                    You may not assign or transfer any rights or obligations under these Terms and Conditions without the prior written consent of GOCABY. GOCABY may freely assign or transfer these Terms and Conditions without your consent.

                    • 19. Relationship of the Parties

                      Nothing in these Terms and Conditions shall be construed as creating a partnership, joint venture, employment, or agency relationship between you and GOCABY.

                      • 21. Governing Law and Dispute Resolution

                        This Policy shall be governed by and construed in accordance with the laws of the jurisdiction where the GO App is used. Any disputes arising out of or relating to this Policy shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.

                        • 22. Severability

                          If any provision of this Policy is deemed invalid or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions of this Policy shall remain in full force and effect.

                          • 23. Entire Policy

                            This Policy constitutes the entire Policy between you and GOCABY regarding the use of the GO App, superseding any prior understandings.

                              If you have any questions or concerns regarding these Terms and Conditions or the GO App, you may contact GOCABY's customer support or visit the GOCABY website for further assistance.

                              By using the GO App, you acknowledge that you have read, understood, and agreed to be bound by these detailed Terms and Conditions. If you do not agree to any provisions of these Terms and Conditions, you may not use the GO App.

                              GOCABY’s Policy for Driver

                              This GOCABY’s Driver Policy (referred to as the "Policy") governs the relationship between GOCABY and drivers (referred to as "Drivers" or "you") who provide transportation services through the GOCABY platform (referred to as the "App" or "Service"). By becoming a GOCABY Driver, you agree to comply with this Policy and all applicable laws and regulations. Failure to adhere to this Policy may result in the termination of your partnership with GOCABY.

                              • 1. Driver Eligibility
                                • 1.1. Driver Requirements: To become a GOCABY Driver, you must meet the following eligibility criteria:
                                  • a) Possess a valid driver's license issued by the appropriate regulatory authority in your jurisdiction.
                                  • b) Own or have access to a registered and insured vehicle that meets the minimum requirements set by GOCABY. Maintain a clean driving record with no history of major violations or criminal offenses.
                                  • c) Comply with all local laws, regulations, and requirements for providing transportation services.
                                • 1.2. Background Checks: GOCABY reserves the right to conduct background checks on Drivers to ensure the safety and security of the GOCABY community. By agreeing to this Policy, you consent to undergo background checks, which may include verifying your driving record, criminal history, and other relevant information. GOCABY reserves the right to refuse or terminate the partnership with any Driver based on the results of these background checks.
                              • 2. Driver Conduct
                                • 2.1. Professionalism: As a GOCABY Driver, you are expected to maintain a high level of professionalism when providing transportation services. This includes treating passengers with respect, maintaining a clean and safe vehicle, and adhering to all applicable laws and regulations.
                                • 2.2. Compliance with Laws and Regulations: You must comply with all local laws and regulations related to providing transportation services, including but not limited to licensing, insurance, vehicle inspection, and tax requirements. Failure to comply may result in the immediate termination of your partnership with GOCABY.
                                • 2.3. Prohibited Activities: As a GOCABY Driver, you agree not to engage in any of the following prohibited activities:
                                  • a) Discrimination: Discriminating against passengers based on their race, ethnicity, religion, gender, or any other protected characteristic.
                                  • b) Harassment: Harassing, threatening, or engaging in any form of misconduct towards passengers or other individuals while providing transportation services.
                                  • c) Intoxication: Operating a vehicle while under the influence of alcohol, drugs, or any other substances that impair your ability to drive safely.
                                  • d) Unauthorized Riders: Allowing unauthorized individuals to ride in your vehicle during a GOCABY trip.
                                  • e) Fraudulent Activities: Engaging in any fraudulent or deceptive activities, including accepting or soliciting payments outside of the GOCABY platform, manipulating fares, or creating false accounts.
                              • 3. Safety and Vehicle Maintenance
                                • 3.1. Vehicle Requirements: As a GOCABY Driver, you are responsible for ensuring that your vehicle meets the minimum safety and maintenance standards set by GOCABY. This includes regular inspections, proper maintenance, and compliance with all applicable vehicle safety regulations.
                                • 3.2. Insurance Coverage: You must maintain valid and adequate insurance coverage for your vehicle as required by law. It is your responsibility to inform your insurance provider about your intention to provide transportation services through the GOCABY platform.
                                • 3.3. Safety Guidelines: You must adhere to all safety guidelines provided by GOCABY, including but not limited to seat belt usage, following traffic laws, and maintaining a safe driving environment for passengers.
                                • 3.4. Legal and Safety Requirements: We may disclose your personal information when required by law, regulation, legal process, or governmental request. We may also share information to protect the rights, safety, or property of GOCABY, its drivers, passengers, or others.
                                • 3.5. Service Providers: We may engage third-party service providers to perform certain functions on our behalf, such as payment processing, background checks, vehicle inspection, or insurance verification. These service providers will have access to your personal information only to the extent necessary to perform their functions and are obligated to maintain its confidentiality.
                                • 3.6. Data Security: We implement appropriate security measures to protect your personal information from unauthorized access, loss, misuse, or alteration. However, no data transmission or storage system can guarantee 100% security. We encourage you to maintain the security of your login credentials and notify us immediately of any unauthorized access or suspected security breaches.
                              • 4. Independent Contractor Relationship
                                • 4.1. As a driver for GOCABY, you acknowledge and agree that you are an independent contractor and not an employee, partner, or agent of GOCABY. You retain full control over the means and methods of providing transportation services and are solely responsible for your own actions and decisions while using the GOCABY platform.
                                • 4.2. As an independent contractor, you are responsible for complying with all applicable laws and regulations regarding self-employment, taxation, and insurance. GOCABY does not provide any employment benefits, such as healthcare or retirement benefits, to drivers.
                              • 5. Availability and Acceptance of Rides
                                • 5.1. Ride Requests: When you are available to provide transportation services, you can accept ride requests through the GOCABY App. You have the discretion to accept or decline any ride request based on your availability, location, and other factors.
                                • 5.2. Timeliness and Reliability: Once you accept a ride request, you agree to arrive at the pickup location promptly and provide the requested transportation service in a reliable and professional manner.
                                • 5.3. Driver Cancellations: Cancelling accepted ride requests may negatively impact the passenger experience and disrupt GOCABY`s operations. Frequent driver cancellations without valid reasons may result in penalties or the termination of your engagement with GOCABY.
                              • 6. Payment Schedule
                                • 6.1. GOCABY will process driver payments on a regular basis, according to the agreed-upon payment schedule. The payment schedule will be communicated to drivers and may be subject to change at GOCABY`s discretion. It is your responsibility to ensure that your payment details are accurate and up to date in the GOCABY driver portal.
                                • 6.2. The payment schedule may vary depending on factors such as local banking practices, holidays, and payment processing times. GOCABY will make reasonable efforts to process payments in a timely manner, but delays may occur due to unforeseen circumstances.
                              • 7. Fare Calculation and Commission
                                • 7.1. Fare Calculation: The fare for each trip is determined by GOCABY based on factors such as distance, time, and demand. The fare displayed to the passenger in the GOCABY app is inclusive of any applicable taxes or fees.
                                • 7.2. Commission: GOCABY will deduct a commission from the total fare for each trip as specified in the agreed-upon commission structure. The commission percentage will be communicated to drivers and may be subject to change at GOCABY`s discretion.
                              • 8. Payment Processing
                                • 8.1. Payment Methods: GOCABY offers various payment methods for drivers, including direct bank transfers, electronic wallets, or third-party payment processors. It is your responsibility to select a preferred payment method and provide accurate payment details.
                                • 8.2. Payment Processing Partners:
                                • 8.3. Card Payments: All card payments are processed by Paystack Ltd, a secure third-party payment gateway. GOCABY does not store or have access to User`s card details. User`s payment information is securely transmitted to Paystack Ltd for payment processing.
                                • 8.4. Wallet and Banking Transactions: All Wallet and Banking transactions are processed through Providus Bank, a trusted banking partner. User`s transactional information is securely transmitted to Providus Bank for processing.
                              • 9. Liability Exemption
                                • 9.1. Payment Issues and Disputes: GOCABY assumes no liability for any issues, errors, failures, or disputes that may arise during the payment process. This includes, but is not limited to, payment failures, errors in processing, unauthorized transactions, or any other related matters.
                                • 9.2. Third-Party Service Providers: GOCABY relies on the services of third-party payment processors and banking partners for payment processing. Any issues or disputes related to payment processing should be addressed directly with the respective third-party service providers. GOCABY will provide reasonable assistance in resolving payment-related issues, but ultimate responsibility lies with the third-party service providers.
                                • 9.3. Driver Responsibility: As a driver, it is your responsibility to ensure the accuracy of your payment details, promptly address any payment discrepancies or issues, and follow the recommended security measures to protect your payment information.
                              • 10. Safety and Vehicle Maintenance
                                • 10.1. Vehicle Requirements: You are responsible for ensuring that your vehicle meets all applicable legal requirements, including registration, insurance, and maintenance. GOCABY may establish minimum vehicle standards, and you must adhere to them to provide safe and reliable transportation services.
                                • 10.2. Insurance Coverage: It is your responsibility to maintain valid and adequate insurance coverage for your vehicle as required by law. You must notify your insurance provider about your intent to use your vehicle for commercial transportation purposes.
                                • 10.3. Safety Guidelines: You must adhere to all safety guidelines provided by GOCABY, including but not limited to seat belt usage, following traffic laws, and maintaining a safe driving environment for passengers.
                              • 11. Termination
                                • 11.1. Termination by GOCABY: GOCABY reserves the right to terminate its partnership with any driver at any time, with or without cause. Reasons for termination may include non-compliance with this Policy, safety concerns, poor performance, or violation of applicable laws and regulations.
                                • 11.2. Termination by Driver: You have the right to terminate your engagement or partnership with GOCABY at any time by providing written notice. However, ongoing trips and commitments must be fulfilled before the termination becomes effective.
                                • 11.3. Consequences of Termination: Upon termination, you agree to return any GOCABY-issued devices, materials, or assets in your possession. Termination does not relieve you of any outstanding obligations, such as outstanding payments or potential liabilities arising from your past actions as a GOCABY driver.
                              • 12. Intellectual Property
                                • 12.1. Ownership: GOCABY retains all ownership rights, including intellectual property rights, to its platform, software, trademarks, and any other proprietary information. You shall not use or reproduce any GOCABY intellectual property without prior written consent.
                                • 12.2. Feedback and Suggestions: If you provide any feedback, suggestions, or ideas regarding GOCABY`s platform or services, you acknowledge that GOCABY may use, modify, or incorporate such feedback without any obligation to compensate you.
                              • 13. Modification of Terms

                                GOCABY reserves the right to modify or update these General Terms for Drivers at its discretion. Any changes will be communicated to you via the GOCABY platform or through other reasonable means. Continued use of the GOCABY platform after the effective date of the changes constitutes your acceptance of the modified terms.

                                • 14. Entire Agreement

                                  These General Terms for Drivers constitute the entire agreement between you and GOCABY regarding your partnership as a driver and supersede any prior agreements or understandings, whether written or oral.
                                  By continuing to provide transportation services through the GOCABY platform, you acknowledge that you have read, understood, and agreed to comply with these General Terms for Drivers. Failure to adhere to these terms may result in the termination of your partnership with GOCABY.                                   Privacy Policy Notice for Drivers

                                  At GOCABY, we are committed to protecting the privacy and personal information of our drivers. This Privacy Notice explains how we collect, use, disclose, and safeguard your personal information as a driver using the GOCABY platform. By becoming a GOCABY driver, you acknowledge and agree to the practices described in this Privacy Notice.

                                  • 1. Information We Collect
                                    • 1.1. Personal Information: When you sign up as a GOCABY driver, we collect the following personal information from you:
                                      • a) Full name
                                      • b) Contact information (phone number, email address)
                                      • c) Profile photo
                                      • d) Date of birth
                                      • e) Residential address
                                      • f) Driver`s license information
                                      • g) Vehicle registration details
                                    • 1.2. Location Information: To facilitate trip bookings and provide navigation assistance, we collect location information while you are logged into the GOCABY driver app. This includes real-time GPS data to track your location during trips.
                                    • 1.3. Usage Information: We may collect information about your interactions with the GOCABY app and platform, including trip details, ratings and reviews, and communication with passengers or GOCABY support.
                                  • 2. Use of Information
                                    • 2.1. Service Provision: We use the collected information to provide transportation services through the GOCABY platform. This includes matching you with passengers, facilitating trip bookings, and providing necessary navigation assistance.
                                    • 2.2. Communication: We may use your contact information to communicate with you regarding trip requests, passenger inquiries, important updates, and promotional offers related to your role as a GOCABY driver.
                                    • 2.3. Improving Services: We analyze driver data and usage patterns to improve our services, enhance driver experience, and optimize the GOCABY platform`s functionality and performance.
                                  • 3. Disclosure of Information
                                    • 3.1. Passenger Information: As a GOCABY driver, you will have access to passenger information such as names, pickup and drop-off locations, and contact details. You are obligated to treat this information as confidential and use it solely for the purpose of providing transportation services through the GOCABY platform.
                                  • 4. Confidentiality and Data Privacy
                                    • 4.1. Confidential Information: During your engagement with GOCABY, you may have access to confidential information, including business operations, trade secrets, and customer data. You agree to treat such information as confidential and not disclose it to any third party without prior written consent from GOCABY.
                                    • 4.2. Data Privacy: You must comply with all applicable data protection laws and regulations regarding the collection, use, and storage of passenger data obtained through the GOCABY platform. You shall not use passenger data for any purpose other than providing transportation services.

                                  Privacy Notice for Users of GOCABY App

                                  • 1. Personal Identification Information
                                    • 1.1. We may collect personal identification information from Users in various ways, including when they register on the App, make a booking, fill out a form, or interact with the App in other ways. The information we may collect includes, but is not limited to, the User`s name, email address, phone number, and payment details.
                                  • 2. Non-personal Identification Information
                                    • 2.1. We may collect non-personal identification information about Users whenever they interact with the App. This may include the browser name, device type, operating system, and other technical information.
                                  • 3. How We Use Collected Information
                                    • 3.1. Personal Information:
                                      • a) To personalize the User experience: We may use the information to understand how our Users as a group use the services and resources provided on our App.
                                      • b) To improve customer service: The information provided helps us respond to customer service requests and support needs more efficiently.
                                      • c) To process payments: We may use the User`s payment information to facilitate bookings and process payments securely.
                                      • d) To send periodic emails: We may use the User`s email address to send them information and updates pertaining to their bookings or to respond to their inquiries or requests.
                                    • 3.2. Non-personal Information: We may collect and use non-personal information for analytical purposes, such as tracking trends, analyzing user behavior, and improving our services.
                                  • 4. How We Protect Your Information
                                    • 4.1. Data Security: We adopt appropriate data collection, storage, and processing practices, as well as security measures, to protect against unauthorized access, alteration, disclosure, or destruction of User`s personal information and data stored on our App.
                                    • 4.2. Data Retention: We may retain your personal information for as long as necessary to fulfill the purposes outlined in this Privacy Notice, unless a longer retention period is required or permitted by law.
                                  • 5. Updates to this Privacy Notice

                                    We may update this Privacy Notice from time to time to reflect changes in our practices or policy and legal requirements. We will notify you of any material changes and seek your consent if required by applicable laws.

                                      We do not sell, trade, or rent User`s personal identification information to others. We may share generic aggregated demographic information not linked to any personal identification information regarding our Users with our business partners, trusted affiliates, and advertisers for the purposes outlined above. By using the GOCABY App, you consent to GOCABY`s collection, use, and disclosure of your personal information as described in the Privacy Policy.
